Terms of Service

1. What Proofolio is

Proofolio is a WhatsApp-native marketing automation service. You send photos of your work via WhatsApp and we return professional image cards, captions, a short-form video, and a live portfolio page optimised for local search. The service is operated as a sole trader business in the United Kingdom.

2. Eligibility

You must be at least 18 years old to use Proofolio. By using the service you confirm that the photos you submit are of work carried out by your business or on your behalf and that you have the right to use and publish them. Proofolio is available to businesses of any size.

3. Free tier

New users receive 3 free job processing credits at full quality. No payment card is required to start. The free tier includes:

• —Professional image cards and captions for up to 3 jobs
• —A live portfolio page that remains active on Google indefinitely — even if you never upgrade
• —Notification when a customer enquiry arrives (contact details withheld on free tier)
• —Weekly analytics report

Your portfolio page will remain live indefinitely regardless of whether you upgrade. We will not delete it without first notifying you and giving you 30 days to export your content.

4. Pro subscription

Proofolio Pro costs £49 per month, billed monthly on a rolling basis with no minimum term. Pro includes everything in the free tier plus:

• —Unlimited job processing within fair use limits (see section 5)
• —Short-form video per job
• —Up to 4 content variants per job (1 original plus 3 regenerations)
• —Customer enquiry contact details delivered directly to your WhatsApp
• —Priority processing

You can cancel at any time. If you cancel, your subscription remains active until the end of your current billing period. Your portfolio page remains live after cancellation. We do not offer refunds for partial billing periods.

5. Fair use policy

Proofolio Pro is designed for active service businesses processing real jobs. To protect the quality and availability of the service for all users, the following limits apply:

These limits are sufficient for the vast majority of service businesses. If you regularly hit the monthly cap and need more, contact us — we will find a solution.

We reserve the right to suspend or throttle accounts that show clear abuse patterns — for example, bulk uploading years of archived photos in a single session, automated or scripted uploads, or any use that places disproportionate load on our systems. We will always contact you before taking action and give you the opportunity to respond.

6. Founding Member pricing

The first 100 users who upgrade to Pro are eligible for Founding Member pricing at £39 per month. This rate is locked permanently for as long as the subscription remains active, regardless of future price increases.

Founding Member pricing is tied to the original subscription. If a Founding Member cancels their subscription and later resubscribes, the standard Pro price at that time applies — the locked rate cannot be reinstated once a subscription lapses.

Founding Member status is non-transferable and applies to one account only.

7. Your content and our licence

You own your photos. You own the marketing cards, captions, and videos we produce from them. By sending photos to Proofolio you grant us a licence to process, store, and display them as part of your portfolio page and to generate your marketing content. You do not grant us the right to use your content in our own marketing without your explicit permission.

You confirm that you have the right to submit the photos you send — that they were taken by you or on your behalf, that they show your own work, and that no third party has a claim over them.

All portfolio pages display a small "Portfolio powered by Proofolio.pro" footer link. This is a condition of the free tier and cannot be removed. Pro users may contact us to discuss white-label arrangements.

8. Verified reviews

Proofolio's review system generates a unique single-use link per job that is sent to the customer who had the work done. Only one review per job is possible. You control whether a review is published on your portfolio page.

You must not send review links to people who did not receive the relevant service, offer incentives for positive reviews, or attempt to manipulate the review system in any way. Violation of this may result in account suspension.

9. Prohibited use

You must not use Proofolio to:

• —Submit photos you do not own or have the right to use
• —Generate content for work not carried out by your business
• —Misrepresent your trade, qualifications, or service area
• —Harass, spam, or send unsolicited messages to customers via the platform
• —Attempt to reverse-engineer, scrape, or automate access to the service
• —Use the service for any unlawful purpose

10. Service availability

We aim to keep Proofolio available at all times but we cannot guarantee uninterrupted service. Scheduled maintenance, third-party outages (including WhatsApp and Twilio), and unforeseen technical issues may occasionally affect availability.

Proofolio is delivered via WhatsApp. We are not responsible for outages, changes, or restrictions imposed by Meta or WhatsApp on their platform. If WhatsApp becomes unavailable or restricts our ability to operate, we will communicate alternative arrangements as quickly as possible.

11. Search engine rankings

We build portfolio pages to best-practice SEO standards to maximise their chance of appearing in Google search results. However, we cannot guarantee specific rankings, positions, or traffic levels. Search engine algorithms are outside our control and change without notice. Our obligation is to build pages that are technically correct and well-optimised — not to guarantee outcomes.

12. Limitation of liability

To the maximum extent permitted by UK law, Proofolio's total liability to you for any claim arising from your use of the service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for indirect losses, loss of business, loss of revenue, loss of data, or any consequential damages arising from your use of or inability to use the service. Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud.

13. Termination

You can cancel your subscription at any time via WhatsApp or by contacting us directly. Cancellation takes effect at the end of your current billing period.

We reserve the right to suspend or terminate accounts that violate these terms, abuse the fair use policy, or engage in behaviour that harms the service or other users. Where possible we will give prior warning. In cases of serious breach we may terminate immediately. If we terminate your account without cause, we will refund any unused portion of your current billing period.

14. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of Proofolio will be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to these terms

We may update these terms from time to time. If changes materially affect your rights or obligations, we will notify you via WhatsApp at least 14 days before they take effect. Continued use of Proofolio after that date constitutes acceptance of the updated terms. The date at the top of this page always shows when terms were last updated.
